The Role Of The EPA

The Environmental Protection Agency (EPA) was created to improve human health through ensuring a safe environment. One of the EPA’s main priorities is to develop and enforce regulations (Adler). The regulations put into place are mandatory requirements that must be obeyed. Regulations can apply to anything, including businesses, state or local governments, private institutions, or individuals (“Regulations”). Even though the EPA serves to help humans by protecting the environment, it can also harm humans. The damages done to our economic lifestyles are getting worse as the EPA gains more power. If it were not for legal scholars being able to publish criticisms of the government, the public may have never known how unconstitutional this plan is. For example, Laurence Tribe, Professor of Constitutional Law at Harvard University, has stated that the Clean Power Plan is crossing the line of EPA’s authority (Loris). Tribe explains that the Clean Power Plan is regulating beyond its jurisdiction by providing alternative scenarios to reduce greenhouse gas emissions that have nothing to do with the power plant itself, and setting standards in emissions-reduction for an entire state, not just the source of emissions (Loris). The Clean Power Plan also fails to meet the “cooperative federalism” role between the states and EPA (Loris). Normally, the states are allowed to implement regulations in how they see fit. However, the Clean Power Plan forces states to implement it against their will (Loris). For instance, the EPA threatens states with the removal of highway funds if they do not follow the plan. (Loris). Additionally, the Clean Power Plan double-regulates power plants in America (Loris). Since the EPA already regulates existing power plants’ greenhouse emissions under section 112 of the Clean Air Act, they cannot regulate it again (Loris). This is because under section 111(d) of the Clean Power Plan, the EPA is not allowed to regulate the same source with the same approach …show more content…
With lower standards, people would get exposed to more bacteria, become sick, and need to go to the hospital (Gustin). It is worth spending the money in order to protect human health. The Clean Water Act, for example, regulates pollutants in water by implementing pollution control programs and setting water quality standards (“Summary”). Without strict regulations like the Clean Water Act, there would most definitely be an increase in water-borne diseases, such as Shigella, Hepatitis A, Giardia, Cholera, and many others. No matter what law is inspected, there will always be benefits to society and the environment. As a matter of fact, most Americans strongly support and trust the EPA in protecting the environment at all costs. According to a poll carried out by the American Lung Association, seventy three percent of voters would allow the EPA to impose stricter rules and limits on pollution from power plants and other industrial facilities
